You must not deny it when a fan directly asks. Under EU AI Act Article 50 a person interacting with an AI must be able to find out that they are, but there is no requirement to announce it unprompted or label every message.

The Act entered into force on 1 August 2024 and applies in stages. The Article 50 transparency obligations for AI systems that interact with people apply from 2 August 2026.

Is it the creator or the chatbot provider who is responsible?

Article 50(1) puts the design obligation on the provider — the system must be built so the person can be informed. A creator can still undermine it by writing instructions that tell the AI to deny being an AI.

Can my AI persona still use a fake name and backstory?

Yes. A persona name, backstory, age, location and personality are all fine. The rule is about answering the direct question honestly, not about being literally autobiographical.
