If you publish AI-generated or AI-edited images, two duties apply. The synthetic output should be marked in a machine-readable way so it can be detected as artificial, and where an image is a realistic depiction of a real person doing something they did not do, it needs to be disclosed as artificially generated.
Those are transparency duties, and they sit on top of a separate one that is older and stricter: you need the right to the likeness in the first place. Marking an image as AI-generated does not make it lawful to have made it.
